Family Offenses / Order of Protection

FAMILY OFFENSES/ORDERS OF PROTECTION

Family offense cases are akin to proving someone you had or have a close relationship with has committed a crime or crimes against you. You may file on your own behalf or on behalf of someone you have a legal relationship with and are incapable of filing on their own such as your child(ren) or ward.

A family offense petition is filed in Family Court with the goal of stopping violence and obtaining protection. This is achieved by the issuance of an order of protection for up to 5 years requiring, among other conditions, the other party, named as the Respondent, to stay away from you, your home, place of employment, to comply with probation, pay up to $10,000 in restitution, participate in a batterer’s accountability program, and/or drug and alcohol treatment.

WHAT CAN THE DROSS LAW FIRM DO FOR YOU?

“When a client seeks an order of protection, it’s close to home for me. My mother is a survivor of domestic violence—violence I witnessed as a child and recall clearly as an adult. Deciding to break the silence and speak out is courageous. It’s part of the reason I became a criminal prosecutor. As a former Assistant District Attorney, I gained invaluable experience by being on the front lines. From interviewing victims, assessing arrests by speaking with police officers and detectives, and reviewing evidence to determining what charges to file and arraigning matters in court, I was hands-on. At The Dross Law Firm, because of our unique blend of in-court legal and out-of-court real-life experiences, we’re able to empathize with our clients, enhancing the attorney-client relationship, client advocacy, and representation. Our clients matter, their family matters, and therefore lived experience matters.” – Arique Dross III, Managing Attorney.
